Terms of Service

By creating an account, accessing, or using CourtCase, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the service.

You must be at least 18 years of age to use CourtCase. By using the service, you represent that you are of legal age.

CourtCase provides automated document organization and timeline generation services for court evidence. We use OCR (Optical Character Recognition) and AI to extract information from your uploaded files and generate formatted documents.

What CourtCase Does:

• Organize uploaded evidence files
• Extract dates, events, and actors using AI
• Generate chronological timelines
• Create exhibit indexes
• Produce PDF documents in professional format

What CourtCase Does NOT Do:

• Provide legal advice or legal opinions
• Create attorney-client relationships
• Represent you in court or legal proceedings
• Interpret laws or suggest legal strategies
• Guarantee court acceptance of generated documents

Pricing is per completed case. Payment is required before downloading final PDF outputs. All payments are processed securely through Stripe.

Pricing Tiers:

• Basic ($15): Up to 50 files, 30-day retention
• Standard ($30): Up to 200 files, 60-day retention
• Premium ($50): Unlimited files, 90-day retention

Refund Policy:

Refunds are available within 7 days if you are unsatisfied with the output quality. See our Refund Policy for details. Refunds are not available for change of mind after downloading or court rejection of documents.

Payment Terms:

• All prices are in USD
• Payments are non-recurring (one-time per case)
• You authorize us to charge your payment method for the selected tier
• Failed payments may result in loss of access to generated documents

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We Specifically Disclaim:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees that courts will accept generated documents
• Guarantees of AI accuracy or completeness
• Guarantees that extracted events are error-free
• Guarantees that the service will be error-free or uninterrupted
• Guarantees regarding third-party services (Anthropic, Stripe, etc.)
• Warranties about suitability for specific legal jurisdictions

You Acknowledge:

• AI may make mistakes in event extraction and date recognition
• Generated timelines must be reviewed and verified before use
• Court formatting requirements vary by jurisdiction and case type
• You are responsible for compliance with local court rules
• No legal outcomes are guaranteed by using this service

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CourtCase, HAIEC, AND OUR AFFILIATES SHALL NOT BE LIABLE FOR:

• Any legal outcomes, court decisions, or case results
• Rejection of documents by courts
• Lost cases, missed deadlines, or unfavorable rulings
• AI errors, incorrect event extraction, or missing data
• Loss of data, files, or generated documents
• Business interruption or loss of profits
• Consequential, indirect, incidental, or punitive damages
• Third-party service failures (Anthropic, Stripe, email services)

Maximum Liability:

Our total liability to you for any claims arising from use of the service is limited to the amount you paid for the service in the 12 months preceding the claim (maximum $50 per case).

You agree to indemnify, defend, and hold harmless CourtCase, Haiec, our affiliates, and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use or misuse of the service
• Your uploaded content
• Your violation of these terms
• Your violation of any laws or third-party rights
• Any illegal or unlawful purpose for which you use the service
• Court rejection of documents you generated using our service

Your Content:

You retain all rights to your uploaded files and generated documents. Your content belongs to you.

License Grant:

By using the service, you grant CourtCase a limited, non-exclusive, royalty-free license to:

• Process your files using OCR and AI
• Generate PDFs from your content
• Store files temporarily (30-90 days based on tier)
• Display your content to you in the application

This license terminates when your data is deleted (either automatically or manually).

Our Intellectual Property:

CourtCase, our logo, design, and service marks are owned by Haiec. You may not use our trademarks without permission. The service software, code, and functionality are protected by copyright and other intellectual property laws.

We May Terminate Accounts That:

• Violate these terms
• Upload illegal, copyrighted, or harmful content
• Abuse or exploit the service
• Fail to pay for services
• Engage in fraudulent activity

Upon Termination:

• Your access to the service will be immediately revoked
• Your data will be deleted within 7 days
• You will lose access to all cases and files
• No refunds will be provided for violations

Voluntary Deletion:

You may delete your account at any time from account settings. All data will be permanently deleted within 7 days.

You agree NOT to:

• Upload illegal, obscene, defamatory, or harmful content
• Violate copyright or intellectual property rights
• Attempt to hack, exploit, reverse engineer, or abuse the service
• Use the service for spam or fraudulent purposes
• Impersonate others or provide false information
• Interfere with other users or the service operation
• Scrape, crawl, or download data from the service
• Violate any applicable laws or regulations

These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Dispute Resolution:

Any disputes arising from these terms or use of the service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, except for claims that may be brought in small claims court (claims under $20,000 in Texas).

CLASS ACTION WAIVER: You agree to resolve disputes individually and waive your right to participate in class action lawsuits or class-wide arbitration.

JURY TRIAL WAIVER: To the fullest extent permitted by Texas law, you waive your right to a jury trial for any disputes arising from these terms.

Jurisdiction and Venue:

If arbitration is unavailable or unenforceable, disputes will be resolved exclusively in the state or federal courts located in Dallas County, Texas or Tarrant County, Texas, and you consent to personal jurisdiction and venue in such courts.

Texas-Specific Provisions:

• This agreement complies with the Texas Business and Commerce Code
• The Texas Deceptive Trade Practices Act (DTPA) may provide additional consumer protections
• Nothing in these terms limits rights that cannot be waived under Texas law

We may modify these terms at any time. Changes will be posted on this page with an updated "Last Modified" date.

For material changes, we will notify you via email or dashboard notification at least 30 days before the changes take effect.

Continued use of the service after changes constitutes acceptance of the updated terms. If you do not agree to the changes, you must stop using the service and delete your account.
